Below are the types of Motions that be can be filed in ongoing and post-Decree Domestic Relations cases A brief description, as well as the required paperwork, is provided.

Motion for Continuance
A Motion for Continuance is appropriate when a court date has been set, and one party cannot attend. A party filing for continuance must show good cause why the hearing should be rescheduled.
Motion for Change of Child Support
A Motion for Change of Child Support is appropriate when the parties have an existing child support Order.
In order for the court to modify an existing child support Order, there must be a change of circumstances, and the modification must be in the best interest of the child(ren).

Motion for Change of Parental Rights & Responsibilities (Custody)
A Motion for Change of Parental Rights & Responsibilities (Custody) is appropriate when the parties have a Decree designating the residential parent/legal custodian of their child(ren).
In order for the court to change the residential parent, the filing party must show a change of circumstances; that changing the residential parent is in the best interest of the child(ren); and that the benefit of changing custody outweighs the harm.

Motion for Change of Parenting Time (Visitation)
A Motion for Change of Parenting Time (Visitation) is appropriate when the parties have an existing parenting time Order. The modification must be in the best interest of the child(ren).

Motion for Change of Spousal Support
A Motion for Change of Spousal Support is appropriate when the parties have an existing spousal support Order. If filing a post-Decree Motion for change of spousal support, the Court must have reserved jurisdiction to modify the duration, amount, or both. Please check your Decree for this information.
In order for the court to modify an existing support Order, there must be a change of circumstances since the initial Order was filed. This motion reopens your old case and a hearing is held after your paperwork is filed.

Motion for Contempt
A Motion for Contempt is appropriate when a party violates an Order of the Court.
Note that personal service is vital in Motions for Contempt because if service is not perfected, certain penalties or sanctions against a party found in contempt cannot be handed down by the court.

If the violation you are alleging involves non-payment of medical expenses, an Explanation of Healthcare Bills must be completed.
Other Motion
If you would like to bring an issue before the court that cannot be done by the other types of motions listed above, you may complete the blank motion form. Please note that depending on the type of motion you want to bring, other documents may be required. Additionally, a Certificate of Service or Instructions must be completed.
Agreed Entry
Agreed Entries are agreements between parties that resolve issues, or modify or terminate orders in their case.
Once parties reach an agreement, they must submit their Agreed Entry to the Court for approval, and the Court will determine if a hearing is needed.
