On Wednesday, September 23, 2020, the trial team of Michele Henne, Victim Advocate Riki Karoyli, and Fairborn Det. Jacob Osburn was successful in convicting Kyle Hicks of Fairborn for Felonious Assault, a felony of the second degree. Back in June of this year, Hicks was involved in a dispute with another person, and proceeded to drive his car head on into the other person’s vehicle. Hicks claimed that he had been assaulted earlier and denied that he drove his car into the other vehicle intentionally. He also claimed his brakes had failed, which was not the case. Det. Osburn was able to find a jail call wherein Hicks admitted to driving his car intentionally into the other car. The trial involved a number of witnesses and Riki made certain they appeared at the trial. Docket Prosecutor Henne thoroughly prepared her witnesses and effectively argued for the jury to find the Defendant guilty.
Once again, our trial team put a lot of extra time getting the case ready for trial. Michele rejected an offer by the defense to plead to a lesser charge, and her decision was vindicated with the guilty verdict. The Defendant faces some mandatory prison time for this charge at sentencing.
