What can I do if I want to dismiss my Civil Protection Order(CPO)?
If you are the Petitioner and the full hearing has not yet been held, you must appear at the scheduled full hearing to make an oral request to have the CPO dismissed.

If the full hearing has already been held and a permanent CPO has been issued, you must file a Motion to Dismiss. You may file a Motion to Dismiss by contacting the attorney of your choice or you may file pro-se. Contact the Domestic Violence Coordinator at (937) 562-6236 for further details.

The Motion to Dismiss will be set for hearing on the Judge or Magistrate's docket, and the Petitioner must attend. If the Judge or Magistrate issues a decision of dismissal and no one objects within fourteen (14) days, the Entry will be filed with the Clerk of Courts.
